A program manager for an assisted living facility in Arizona may proceed with his claim that the facility violated the Fair Labor Standards Act by failing to pay him overtime. The parties dispute the number of hours that he worked and how much he was paid and a question remains about whether or not the manager fell within FLSA’s administrative exemption. The case is Radford v. Berg Homes LLC, 2020 BL 47240, D. Ariz., No. CV-18-00287-PHX-DWL, 2/10/20.
