A New York federal district court granted preliminary approval of a $1 million class action settlement between delivery drivers/helpers and Manhattan Beer Distributors, LLC under the Fair Labor Standards Act and New York Labor Law for unpaid overtime wage claims and unlawful wage deductions, finding the settlement fair and reasonable after evaluating Rule 23 factors, including that the settlement represented 60.61% of the maximum potential recovery, the parties engaged in arm’s length negotiations with experienced mediators, and the class certification requirements of numerosity, commonality, typicality, and adequacy were satisfied.
