A South Carolina federal district court denied Clarendon County’s motion for summary judgment on a paramedic/firefighter’s claim under the Fair Labor Standards Act that she was improperly classified as exempt from traditional overtime requirements, finding a genuine issue of material fact existed as to whether the employee had the “responsibility to engage in fire suppression” as required for the fire protection activities exemption, despite her having the legal authority, training, and equipment for firefighting.
