A South Carolina federal district court found a home health care worker sufficiently pleaded that she and a putative class weren’t compensated for their overtime work in violation of the Fair Labor Standards Act and the South Carolina Wage Payment Act, despite Cold War Citizens Care, LLC billing the government for services, and denied the company’s motion to dismiss on those grounds, although the health care worker’s state law subclaims for unpaid benefits and lack of notice were dismissed.
