The Second Circuit ruled that a hotel near John F. Kennedy International Airport can’t overturn or reduce a former chef’s $1,024,267 damages award that is based on its failure to pay him overtime wages under federal and state labor laws. The determination of whether the chef was an exempt executive under the Fair Labor Standards Act presented a mixed question of law and fact, the court said, the trial judge was in the best position to assess the credibility of the witnesses and other evidence, and the trial record supported the judge’s finding that the chef wasn’t an exempt employee. ...
