The Ninth Circuit holds that Zumiez, Inc., and other California retailers must pay employees scheduled for call-in shifts, even if they aren’t required to come into work. The federal court follows the lead of a recent California Court of Appeal opinion that concluded that California Wage Order 7—under which employers must pay reporting time pay to retail employees who report to work but aren’t used—also applies to call-in shifts.
