New Albertsons Inc. isn’t entitled to dismissal from a former Jewel-Osco assistant store manager’s lawsuit alleging collective claims under the Fair Labor Standards Act, in which the employee alleges that it is liable as a joint employer for misclassifying her and others as exempt from overtime, a federal district court in Illinois ruled.
