A federal court rejected Mobile Phlebotomy of Central Michigan LLC’s arguments about a group of phlebotomists’ initial agreement to be independent contractors, the necessity of joining healthcare providers, and the unclean hands doctrine, in a Fair Labor Standards Act dispute over unpaid overtime, applying the “economic reality” test to find that most factors favored classifying the phlebotomists as employees, and granting them summary judgment, while denying the employer’s cross-motion.
