A high school Academic Dean for a Texas school district is entitled to a trial on his claim that he was discharged in retaliation for his use of leave under the Family and Medical Leave Act, rather than because he was unable to work with co-workers and supervisors, a federal court in Texas ruled. The district gave shifting explanations for its decision and he received a glowing performance review soon after his termination that rated him as exceeding expectations in the area of his relationships with his supervisors and in modeling professional behavior with the faculty, the court said.
