A Louisiana federal court denied summary judgment to Union Parish School Board on claims of retaliation and interference under the Family Medical Leave Act of a chief financial officer who was discharged on the same day that she submitted a request to take FMLA leave, finding that although poor work performance was a legitimate reason for the Union to terminate her, a reasonable jury could conclude that her request for leave was an additional motivating factor in the decision to terminate her.
