A federal district court granted summary judgment to Lee Memorial Health System for allegations of FMLA retaliation and interference by a resident physician who was terminated after requesting leave to deal with medical issues. The court found that the physician was granted 12 weeks of FMLA leave and that she failed to show she was denied a benefit that she was entitled to. Further, the four-month period between her leave and termination is too attenuated to support a causal connection and she can’t show that the health system’s reasons for termination, her failure to meet a condition of her employment ...
