A Florida federal district court denied summary judgment to the Sheriff of Charlotte County, on Family Medical Leave Act interference and retaliation claims brought by a former support services supervisor who was terminated after leaving his post during Hurricane Milton to care for his wife who thought she was having a heart attack, finding genuine issues of material fact exist regarding whether the supervisor’s wife had a qualifying serious health condition, whether the supervisor provided adequate notice, and whether the sheriff would have terminated him regardless of the FMLA request.
