An Illinois federal district court granted in part and denied in part a post-trial motion under the Family and Medical Leave Act by a Commonwealth Serum Laboratories Behring employee who was terminated for a late call-off, denying liquidated damages because the employer demonstrated good faith by investigating FMLA implications before termination, denying front pay because the employee had secured comparable employment as a signalman for Union Pacific and the requested 21-year timeframe was speculative, but granting prejudgment interest on the $57,500 back pay award that the jury had previously granted to the employee against Commonwealth.
