The U.S. Court of Appeals for the Tenth Circuit affirmed summary judgment to Best Buy Co., Inc. on an employee’s claims under Colorado’s Healthy Families and Workplaces Act and Public Health Emergency Whistleblower Act, finding that the employee was terminated for violating the company’s attendance policy by missing three consecutive days of work without notice after recovering from Covid-19, rather than as retaliation for using the Covid-19 policy or complaining about violation of a public health order.
