An Ohio federal court granted summary judgment in favor of The Children’s Home of Cincinnati on a former employee’s disability-related claims because she didn’t establish a disability under the ADA, but her retaliation, FMLA interference and wrongful discharge claims will go to trial, where she reported assaults by students and injuries, and there were disputed material facts regarding whether her resignation was voluntary as well as an alleged policy against filing charges against students.
