The city of Philadelphia is entitled to summary judgment on a claims adjuster’s claims of interference and retaliation under the Family and Medical Leave Act, a federal district court in Pennsylvania ruled. The employee alleged that he was improperly denied FMLA leave and later terminated. His interference claim was denied because a reasonable factfinder would determine that the city’s accounting would accurately show that he didn’t work the required number of hours to be eligible for FMLA leave, the court said.
