A Michigan federal district court partially denied Common Ground’s motion to dismiss Family Medical Leave Act claims brought by an employee, while dismissing her Americans with Disabilities Act claims as time-barred, finding that although the ADA claims exceeded the 90-day filing deadline after receiving her right-to-sue letter, the company hadn’t moved to dismiss the FMLA claims based on their two-year statute of limitations, and the court wouldn’t make arguments for the parties under the principle of party presentation.
