A South Carolina federal court denied summary judgment to Spartanburg Community College on the claims of an employee that his Family and Medical Leave Act rights were interfered with, and he was discharged for exercising those rights, in violation of the act, ruling that by categorizing the employee’s leave as unauthorized when it had been authorized, and then discharging the employee as a result, the college interfered with his FMLA rights and retaliated against him for exercising those rights.
