A Next Process, Inc. manager’s motion to dismiss the Fair Labor Standards Act claims of a discharged lead tolling operator alleging that he was prohibited from further overtime work after complaining of unpaid overtime is denied, a Pennsylvania federal district court ruled, because the operator’s complaint plausibly pled that the manager is an employer as defined by federal law, and that the operator complained to the manager, who in response barred him from additional overtime.
