Trucking company Hard Drive Express, Inc. and its owner are entitled to summary judgment on a discharged truck driver’s claim that they retaliated against him in violation of the Fair Labor Standards Act and the Michigan Whistleblowers’ Protection Act, a federal court in Michigan ruled. The driver failed to raise a genuine issue of fact as to whether he experienced retaliation under the FLSA, given that his oral complaint to the owner immediately before he was terminated only related to his entitlement to vacation pay, a fringe benefit not covered by the FLSA, the court said.
