A Pennsylvania-based home health-care company and its CEO must pay double damages for overtime and recordkeeping violations of the Fair Labor Standards Act. The Department of Labor sued Heart 2 Heart and its CEO and owner, alleging FLSA overtime, recordkeeping, and employee classification violations. DOL contends that H2H and its owner acted willfully, claiming they used sham staffing agencies to misclassify the workers, planted false information in payroll records, and withheld employment records during the government’s investigation of the alleged violations. The case is Acosta v. Heart II Heart, LLC, 2019 BL 393236, W.D. Pa., No. 2:17-cv-1242, 10/15/19.
