A poultry loader/catcher may proceed with his Fair Labor Standards Act action for unpaid overtime against turkey producer Butterball, LLC, a federal district court in North Carolina ruled. The employee typically worked a night shift six days a week, and he claimed he worked approximately 90 hours a week, the court said. The court determined based on a second amended complaint and his pay stubs, that the poultry loader/catcher plausibly alleged he regularly worked more than 40 hours in a given work week, and that Butterball regularly owed him overtime pay.
