A federal district court granted ControlWorx summary judgment on a quality assurance specialist’s Family and Medical Leave Act interference and retaliation claims alleging that he was terminated after requesting leave and accommodations related to a shoulder injury. The court found that the specialist failed to provide evidence of interference as he used up all of his available FMLA leave for the 12-month period, was granted three additional gratuitous weeks of leave, and wasn’t yet entitled to a new set of leave under the company’s rolling FMLA leave schedule.
