Dolgencorp, LLC’s motion to dismiss the Fair Labor Standards Act collective action of 10 named employees on behalf of themselves and 46 opt-in employees alleging minimum wage and overtime claims is denied, because of the unmanageable nature of a lawsuit with 75 individually named plaintiffs, and the necessity of entitling employees to court-facilitated notice to potential additional opt-in employees is inapplicable in this case, a Tennessee federal district court ruled.
