Case: Wage & Hour/Fair Labor Standards Act (M.D. Ga.)

The district court granted a sheriff and Macon-Bibb County summary judgment as to deputies’ claims alleging that they weren’t paid for time spent on-call, in violation of the Fair Labor Standards Act. The deputies who worked in a variety of different divisions alleged that they were entitled to pay for on-call time under a county employee manual, but their claims are barred by the sheriff’s 11th Amendment immunity, the court said. Further, although the county provided some administrative functions related to the deputies, it wasn’t their employer, the court ruled.
