A Pennsylvania federal district court rejected a proposed settlement agreement between Kulicke and Soffa Industries, Inc. and an employee claiming that the employer didn’t properly pay all owed overtime wages in violation of the Fair Labor Standards Act, ruling that the agreement’s confidentiality clause is too restrictive and the claims release provision is too broad, with both provisions as currently written being unlawful for frustrating the purposes of the FLSA.
