Case: Wage & Hour/Fair Labor Standards Act (E.D.N.Y.)

Five former employees of Kabbalah Centre International must arbitrate their numerous wage and hour claims alleging violations of the Fair Labor Standards Act and state laws, a federal district court in New York decided. The employees signed separation agreements containing an arbitration clause, and they failed to show that the agreements were unenforceable due to alleged coercion or undue influence or that their claims were outside the scope of the agreement, the court found. The claims of two other former employees were dismissed as untimely under FLSA’s statute of limitations requirements, the court stated.
