A Missouri federal district court denied MHM Health Professionals, LLC’s motion for partial summary judgment on claims under the Fair Labor Standards Act, Arizona Wage Act, and Arizona common law brought by a non-exempt employee and similarly situated employees who alleged they were untimely and underpaid following a ransomware attack on the company’s timekeeping software, finding genuine issues of material fact existed whether MHM paid employees “as soon as practicable” when it collected accurate time data during the outage but chose not to use it for calculating pay.
