A Utah federal court granted Rule 23 class certification to a group of employees claiming that their employer, MP2 Enterprises, willfully failed to pay them all required minimum wages, in violation of the Fair Labor Standards Act, ruling that the plaintiffs adequately demonstrated the requisite numerosity, commonality, typicality, and adequacy for the proposed class to proceed with a class action, and showed that common class questions were more prominent than questions for individual employees.
