The United States Court of Appeals for the First Circuit affirmed the Massachusetts federal district court’s enforcement of a global settlement agreement and approval of a class action settlement of wage claims under the Fair Labor Standards Act and state law brought by former hotel employees against The Wheatleigh Corporation and its owners, finding that despite potential conflicts, the attorney’s concurrent representation of both individual plaintiffs and a class did not preclude approval of the settlement where counsel secured recoveries for each class member exceeding their actual damages, and no class members objected to the settlement.
