A Pennsylvania federal district court denied summary judgment to an owner of Lee’s House Restaurant, Inc. on a delivery driver’s claims of failure to pay minimum wage and overtime under the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act, finding that a factual dispute existed as to whether the owner was his employer after his testimony that the owner managed him in the kitchen, paid his compensation, and hired another employee.
