A federal district court granted Palco Inc. summary judgment on a home caregiver’s claim alleging that it was her joint employer under the Fair Labor Standards Act and the Arkansas Minimum Wage Act. The court found that despite Palco maintaining some of the caregiver’s employment records, no reasonable jury could conclude that it was her joint employer because she was paid under a government-funded Medicaid program whose participants were responsible for hiring and firing caregivers, managing the caregiver’s day-to-day tasks, and controlling the caregiver’s employment conditions.
