A California Court of Appeal reversed summary judgment granted to a Chef on Fire LLC part-owner on labor code violation claims brought by a restaurant manager under state law, finding that the manager’s complaint properly alleged the owner’s individual liability as a managing agent who enforced company policies resulting in wage and hour violations, and that Chef, the part-owner, and others failed to meet their initial burden to show that she couldn’t be held individually liable as an “other person acting on behalf of an employer” who caused the violations.
