A Missouri federal district court granted in part and denied in part a motion for conditional certification under the Fair Labor Standards Act and class certification under Rule 23 filed by a certified nursing assistant against MHM Health Professionals, LLC, certifying the Kronos timekeeping outage claims because all employees were subject to the same company-wide policy of estimating wages and “netting” reconciliation payments, but denying certification of meal break claims because employees had widely varying experiences with the meal break auto-deduction policy across different facilities and positions.
