A federal court in Missouri denied the Fair Labor Standards Act collective action motion for conditional certification of a St. Luke’s Episcopal-Presbyterian Hospitals, Inc. registered nurse alleging non-payment for meal breaks during which she could have been asked to serve patients, where the possibility of having to work during the meal breaks doesn’t show a federal law violation, and case law already determined it isn’t realistic to pay employees for meal breaks that could be interrupted.
