Aldi Inc. store managers seeking overtime pay under the Fair Labor Standards Act for regularly working more than 40 hours per week because of the discount grocery chain’s alleged systematic under-staffing can’t proceed as a nationwide collective. The lead plaintiffs didn’t submit any evidence showing that their job duties at their stores in Maryland—where they allegedly performed a substantial amount of non-managerial tasks— were representative of work performed by other Aldi managers nationwide as some managers reported that they hardly did any manual work and mainly performed supervisory tasks, the court said. The case is Hunt v. Aldi, Inc., 2020 BL 97219, D. Md., 818-cv-2485-PX, 3/16/20
