An employee’s motion for conditional certification on allegations that Ocean Spray Cranberries Inc. didn’t compensate pre-shift work nor properly calculated regular pay rates for overtime is granted in part and denied in part, a federal court ruled, stating that although there’s sufficient evidence that the company’s policy of excluding shift premium compensation and bonuses is uniform across facilities, he didn’t show how long pre-shift or post-shift work take at other company locations.
