A Colorado federal district court granted a motion for court-authorized notice pursuant to the Fair Labor Standards Act filed by an account manager who alleged that HotelEngine, Inc. misclassified him and other sales employees as exempt from overtime requirements, finding that the account manager met the relatively low threshold for conditional certification by showing that all sales employees, regardless of title, were subject to a common policy of being classified as exempt from overtime requirements despite regularly working more than 40 hours per week to meet sales metrics.
