A Louisiana Court of Appeal vacated and remanded the New Orleans Civil Service Commission’s decision denying a senior principal engineer’s request for consideration of the city Sewerage and Water Board’s prior request for retroactive “extraordinary qualifications” pay for him, where the Commission’s refusal to consider evidence from after his promotion date because of policy, case precedent, and the need to avoid creating an improper exception to city rules, was arbitrary and capricious.
