A group of beauty salon service technicians for BKP Inc. may proceed as a class on their claims under Colorado law that they weren’t paid for straight time, or earned commissions, and their tips were improperly withheld, a federal district court ruled. The minimum wage act downtime class, the wage claim act downtime class and the commission and tip theft class are ascertained through the objective criteria of a specific time period at a specific location as a service technician, and any overlap between class members resulting in individualized or different damage calculations doesn’t defeat certification, the court said.
