A New York federal district court denied Compass Group USA, Inc.'s motion to compel arbitration of a former barista’s claims under the Fair Labor Standards Act and New York Labor Law, finding that the arbitration agreement signed by the union member was an unlawful “side agreement” that violated the National Labor Relations Act by intruding upon the exclusive bargaining authority of the union local, as a management rights clause in the collective bargaining Agreement did not authorize individual arbitration agreements.
