A California federal district court granted Artech Information Systems and Kaiser Foundation Health Plan’s motion to compel arbitration of a case manager’s claims under the California Labor Code for wage and hour violations, meal and rest period violations, and other labor law claims, finding that the arbitration agreement’s delegation clause was enforceable despite the plaintiff’s arguments that it was procedurally and substantively unconscionable, as the court found only a moderate degree of procedural unconscionability and limited substantive unconscionability.
