The Maryland federal district court denied Statesville Painting and Maintenance LLC and SPM Builders, LLC’s motion to dismiss claims brought by the International Painters and Allied Trades Industry Pension Fund and other employee benefit funds under the Employee Retirement Income Security Act of 1974, finding that companies failed to challenge the funds’ alter ego/single employer theories, arbitration provisions didn’t apply to the funds, SP Fund plaintiffs were properly joined, and plaintiffs adequately pled a basis for injunctive relief and damages.
