The National Labor Relations Board ruled that Rosewood Care violated the National Labor Relations Act by unilaterally changing the rules for union access to the employer’s facility and threatening legal action against union representatives for engaging in protected union activities on the property. The board ruled that the changes to the access rules were not only made without engaging in bargaining over the issue, but also prevented the union representatives from fulfilling their duties. In addition, the board found that the employer unlawfully discharged an employee hours after being informed that he had been elected as a union steward.
