UPS, a nationwide parcel delivery company, unlawfully fired an employee for opposing ratification of a union contract in violation of the NLRA, even though a grievance panel exonerated the company. The NLRB majority refused to defer to the grievance panel’s decision in the company’s favor because it found that those proceedings weren’t “fair and regular.” All four panel members and the union official representing the employee in the case were involved in negotiating the collective bargaining agreement that the employee campaigned against.
