The NLRB is entitled to enforcement of its orders requiring Alaris Health, a New Jersey healthcare company, to reinstate union employees who went on strike to protest unfair labor practices at its nursing homes, the U.S. Court of Appeals for the Third Circuit ruled. Alaris Health’s claim that it amended staffing contracts to replace the striking employees doesn’t excuse their delayed reinstatement, which took over a month, the court said. The National Labor Relations Act’s substantial business justification exception to immediately reinstating employees doesn’t apply to unfair-labor-practices strikes, and even if it did, there’s no evidence that Alaris’ staffing issues ...
