The National Labor Relations Board ruled that a Florida gaming and entertainment company violated the National Labor Relations Act by failing and refusing to furnish the union with the opportunity to view requested relevant video evidence of an incident that led to the discipline of two unit employees. The board upheld the ruling of the administrative law judge that the employer failed to timely raise a confidentiality defense, and that the video evidence was necessary to the union’s representation of the employees during the grievance process.
