A group of three symphony orchestras comprising one employer in Texas violated the National Labor Relations Act by unilaterally modifying its master labor agreement with the musicians union representing the orchestra members on provisions regarding wages and exigent circumstances for emergency situations. The National Labor Relations Board upheld the administrative law judge’s ruling that because this was a proposed midterm change to a portion of the contract that was a mandatory subject of bargaining, the union was under no obligation to bargain over the change, and the employer had no right to unilaterally implement that change.
