A federal court denied the Gloucester County Sheriff’s Offices’ motion for summary judgment on a retired officer’s claim alleging discrimination in violation of the Uniformed Services Employment and Reemployment Rights Act based on his protected military service as a member of the New Jersey Army National Guard. Material issues of fact remain, including whether his military service, which included five overseas deployments, motivated GCSO’s decision to suspend him for 20 days, as well as whether the suspension was excessive in light of the circumstances, the court ruled.
