The National Labor Relations Board upheld an administrative law judge who relied on board precedent to find that Prime Communications LP’s severance agreement violated the National Labor Relations Act. The board found that the ALJ reasonably ruled that the language of the company’s severance agreements banning disparaging language against the company could reasonably be seen as restrictive of the signers’ rights to engage in protected organizing activity. In doing so, the board declined to overturn a 2023 case that banned severance agreements with overly broad or restrictive language which could be interpreted to interfere with workers’ organizing rights.
